1. Ownership

All pages within the Sites and any material available for download are the property of Havenside and/or its subsidiaries or affiliates. The content on the Sites is provided to you without charge as a convenience and for your informational purposes only. The Sites offer educational information only to our organization, its services, and how to retain those services. Havenside hereby grants you a non-exclusive license to use the Sites solely for your personal, non-commercial use. Use of the Sites by an individual under the age of 13 is not permitted. By accepting our terms and conditions through use of the Sites, you confirm that you are either a legal adult over the age of 18 years or under the supervision of a parent or legal guardian who has agreed to be bound by these terms and conditions on your behalf. If you are a parent or legal guardian who has agreed to be bound by these terms and conditions on behalf of a child, you agree to be fully responsible for any potential liability resulting from that child’s use of the Sites.

3. Product Orders

In the event that you purchase any goods or services from Havenside, a separate contract will govern that transaction. By placing an order, you agree to be held responsible for and pay all charges incurred through the use of your account. Additionally, placing an order constitutes a representation that you have complied with these terms and conditions and that all products will be used in a lawful manner.

If we believe that your conduct violates these terms and conditions or any applicable laws, we reserve the sole right, with or without notice, to limit the availability of any product or service; bar any user from making any transactions; or suspend and/or terminate your account.

4. Copyright

The contents on the Sites are copyrighted and may not be distributed, modified, reproduced or used, in whole or in part without the prior written consent of Havenside. Downloading or printing information from the Sites to a single computer for informational, personal and non-commercial use is permitted as long as all copyright or proprietary information remains intact.

Havenside responds to notices of alleged copyright infringement pursuant to the Digital Millennium Copyright Act (“DMCA”). If you believe that any content infringes upon your copyrights, you may request removal by contacting our compliance department through the information provided at the end of these terms and conditions. You must satisfy all requirements of the DMCA. Havenside reserves the right to disregard a notice that fails to comply with DMCA requirements or is unclear.

5. Website Uptime

We take all reasonable steps so that the Sites are available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and other technical issues. In no event shall Havenside be liable for any damages or injury, including any direct, special, incidental, consequential, punitive or other damages, that may result from unavailability of the Sites.

The Sites may be temporarily unavailable due to issues such as system failure, maintenance or repair, or for reasons beyond our control. Where possible, we will try to give our users advance warning of maintenance issues, but shall not be obliged to do so.

12. User Conduct

When using the Sites, you shall not post or send to or from either the Sites:

14. Disputes and Governing Law

YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED. The Terms of Use and Privacy Policy are governed by the laws of the Commonwealth of Pennsylvania, United States and controlling United States Federal Law. By accepting these terms and conditions, you agree that any action pertaining to or arising out of these terms and conditions, the Sites, or our Services shall be maintained in state and/or federal courts located in Allegheny County, Pennsylvania.
